New Image Lighting

1. Prices quoted are not subject to V.A.T.
2. Before collection of goods - 2 forms of I.D. will be required - a) Passport and b) Recent Utility Bill (Last 3 Months) / Driving License.
3. A refundable deposit will be taken via Credit Card on collection of goods for a percentage of the cost of the goods being hired. - This rate will depend upon the total value of the goods hired. The deposit will always be made to a nominated credit card in the customers name or company name thatthey represent.
3. (a) New Image Lighting T/A CnJ DJ's Ltd highlight the following situation could arise. When placing a deposit on a credit card, if the credit card statement (the bill) is produced during the period of hire, before the deposit is returned to the card, the customer may have to pay the deposit as part of the balance of the statement, however the next month, the credit card will be in credit by the deposit amount, we ask you bear this in mind when placing orders to avoid any interest charges you may incur as a result.
4. The customer (person hiring goods) will be responsible for the goods at all times, and protecting them from adverse weather (e.g. Direct Sunlight, Rain, excessive winds), harsh environments, and crowds if warranted.
5. The customer accepts full responsibility and is liable for any damages, injuries caused directly or indirectly by the goods, theft of equipment, other loss of equipment (e.g. by fire or water damage etc), or any other circumstances that cause the loss or malfunction to the goods.
6. It is advisable that the customer takes out their own insurance against the goods for any of the points highlighted in (5).
7. It is advisable that the customer takes out their own Public Liability Insurance against claims relating to personal injury whilst using the goods. As New Image Lighting T/A CnJ DJ's Ltd, can not be held responsible for the installation methods used whilst erecting the goods nor will they be liable for the positions that goods have been erected in or the manner in which goods have be placed in areas particularly in public places - such as Tripod legs causing a trip hazard.
8. The customer is responsible for his or herr own Risk Assessment and Method Statements.
9. All equipment will be inspected upon return to New Image Lighting, once inspected, any damages / malfunction of equipment or missing items shall be payable at the total cost for repair(s) and / or replacement of goods.
10. The costs in (9) will be invoiced to the credit card the deposit was taken on. If the cost of replacement goods / repair(s) is less than the deposit value, then the replacement / repair costs will be deducted from the deposit amount and the remaining funds will be credited back to the customer. If the cost of the goods / repair(s) are greater than the deposit, then the deposit will not be refunded, and the extra costs shall be invoiced. Payable by the credit card used for the deposit or cash.
11. Payment for the hire of goods can be made by cash on collection, cheque with guarantee card on collection, or credit card. But the deposit will always be made to a nominated credit card in the customers name or company name whom they represent.
12. Company's / Organisations / Charities must provide proof of trading upon collection, such as letter head with the registered office address, company registration number (Companies House) or Charity Registration Number.
13. On the last day of hire, goods should be returned to our office by 5:30pm. In the packaging they were issued with and all instruction, health and safety guidance, operation manuals placed back with the appropriate goods.
14. Cables must be returned clean and wrapped orderly with no twists or knots, New Image Lighting will cable tie them on return and after inspection.
15. New Image Lighting T/A CnJ DJ's Ltd, hold no responsibility for personal injury of any type caused through lasers that have been dry hired, we are not responsible for the positioning and safety of the lasers whilst we are not present. The most powerful laser available for dry hire is our 10mw Green laser. Our 300mw and 1000mw laser systems will be supplied with a fully trained operator for the whole duration of the hire.
16. Collection and Delivery of goods to / from a venue will be chargeable at £0.35p per mile travelled.
17. Installation and removal of goods by our staff will be chargeable at £20 / hour / member of staff.
18. All of our equipment is P.A.T. Tested and is visually inspected before leaving our premises, however, due to the nature of the industry, we can not be held responsible for goods damaged on site then used by the customer, and later causes personal injury directly or indirectly or even death. Any damages must be reported immediately to New Image Lighting T/A CnJ DJ's Ltd by the contact details provided, and the equipment in question must not be used.
19. Certain types of goods we supply can generate excessive temperatures that will cause severe burns instantly, therefore only responsible adults should install, operate and dismantle the equipment. However the customer is responsible for the actions of all persons in relation to the collection, installation, operation, dismantling and return of goods, where appropriate the customer should employ a trained technician.
20. The replacement of lamps in luminaires shall only be undertaken by a representative of New Image Lighting, if a lamp fails you must contact New Image Lighting immediately, do not try to undertake the lamp change yourself as you could be liable for any damages (such as lenses and glass reflectors etc.) and loss of parts. But also there is a very high risk of electric shock resulting in severe injury or even death, and there is also a very high risk of severe burns. By contacting New Image Lighting, we shall supply the correct lamp type and arrive on site as prompt as possible and undertake the lamp change for you. If there is damage to the unit in question resulting in the lamp failure, you will be liable for a call out cost, cost of the lamp and any repairs or replacement of the unit.
21. It is advisable that expensive equipment, such as Control Desks/Units, DMX Distribution units, Pyrotechnic Hardware is stored in a secure room overnight with their power supply units. You will be held responsible for the theft of items.
22. The customer is responsible for checking the maximum capacity on a venues ring main electrical circuit (e.g. the maximum current allowed - usually the rating of the Breaker / Fuse in Amps) and also to assess what equipment if any is already connected to the circuit. To calculate the current - Add together the wattage of all the equipment (Watts) and divide the figure by 230 (230 Volts is the average value of UK A.C. voltage at 50Hz) - the answer will be the current that will be drawn by the equipment. New Image Lighting T/A CnJ DJ's Ltd will not be held responsible for failure or fire caused by means of overloading an electrical circuit.
23. Weekend hire rate is charged at 2 day hire rate. Collection of goods must be made between 12 noon and 15:00 Friday. All goods hired must be returned by 12 noon on the Monday. Bank Holiday Weekends will be charged at 2 days + 30%, collection between 12 noon and 15:00 Friday and returned by 12 noon Tuesday.
24. Early collection or late return of goods hired will incur a charge of an extra one day hire for each day early or late – charged at 1 day hire rates.
25. Before any goods are taken the customer will be asked to read and sign/date a copy of these terms and conditions to prove that the customer agrees, failure to agree will void the hire and no hire of goods shall be allowed.
26. By paying a deposit by use of cash or credit card, you are accepting these terms and conditions.
27. By paying for hire of goods by use of cash, cheque or credit card you are accepting these terms and conditions.
28. Refundable deposits may only be left by cash or credit card using our online payment service.
29. The cost of Hire may be paid by credit card, cheque or cash, before collection only. Cheques to be made payable to New Image Lighting, Or, CnJ DJ's Ltd.
30. Our credit card facility uses Paypal - paying by credit card, the customer is bound by any terms and conditions of Paypal and any of their agents, and agree to pay any of their fees where applicable. New Image Lighting are not responsible for Paypal terms and conditions or any matters arising from the payment process such as fraud etc, all these matters should be taken up with Paypal - further information can be found at www.paypal.com.
31. The customer is responsible for selecting the correct deposit amount on our website, failure to select the amount quoted could result in a refund of the money plus any surcharge for handling the money. Also the contract between New Image Lighting T/A CnJ DJ's Ltd and the customer may be invalidated if the deposit amount is too low compared to the quoted amount.
32. New Image Lighting T/A CnJ DJ's Ltd are not responsible for damages to third party materials caused by any of our equipment. The customer is responsible for the safe collection, transport, installation, operation and removal of goods hired.
33. Goods shall only be used for there intended use and be kept in the condition and assembly state they were supplied to the customer. The dismantling of goods is not allowed by the customer and will only be undertaken by an authorised representative of New Image Lighting T/A CnJ DJ's Ltd, for instances such as repair or lamp replacement.
34. Cheques or payment s that are refused or rejected by our bank will incur a £40 handling charge extra to the hire costs.
35. We reserve the right to add interest charges to any moneys that have been refused or rejected by our bank.
36. If for any reason whatsoever, a Health and Safety officer as any issues with the equipment you have on hire, you must contact us immediately by any the means overleaf. If for any reason our equipment cannot be used for Health & Safety reasons, a written Health and Safety report must be supplied to New Image Lighting at the earliest opportunity. This report must be signed and name printed by the Health and Safety officer and be written on headed note paper of the venue where the equipment / goods are being used.
37. Cancellation of any equipment or service hire within 28 days of any project will incur a cancellation fee of 15% of the quotation / invoice amount plus additional costs (though not limited to) any vehicle / equipment hire charges, consumables for example pyrotechnic effects / gels and gobos etc. Receipts will be made available.
38. Verbal orders shall be taken over the phone, if you book / confirm on the phone we shall deem this to be an order and shall be entered onto our booking system. Verbal orders shall be confirmed back to the client with an email confirmation / invoice.
39. The client (person making the booking) is responsible for crowd control at any event/venue, and therefore attains responsibilty for the protection of any equipment supplied by New Image Lighting throughout the event. You are responsible for any damage as highlighted in point 5 of the Terms & Conditions.
40. These Terms & Conditons may change without prior notification, E&OE.
